INJUNCTION PROCEEDINGS FEES

If you are the Applicant or Defendant, the costs will depend very much upon the nature, length and complexity of the proceedings. As a general guide we would indicate as follows:

Application under Family Law Act 1996

Preparing application and all steps up to and including the First Hearing

Time spent basis

£4,000 (plus £800 VAT) to £6,000 (plus £1,200 VAT).
(a Barrister may also be instructed at between £1,500 (plus £300 VAT) to £2,500 (plus £500 VAT)

Continuing Proceedings

Preparing and Considering statements and attending any Further Directions Hearing

Time spent basis

In addition to the above £6,000 (plus £1,200 VAT) to £10,000 (plus £2,000 VAT).
[A Barrister may also be instructed at £2,000 (plus £400 VAT) to £3,000 (plus £600 VAT)

Contested Proceedings

Preparing for and attending the Final Trial

Time spent basis

In addition to the above £12,000 (plus £2,400 VAT) to £20,000 (plus £4,000 VAT).
In addition: Barristers fees in region of £2,500 (plus £500 VAT) to £5,000 (plus £1,000 VAT)

 

The above assumes that the proceedings relate to one substantive non-molestation and/or occupation order, and if there are at the same time Children Act issues, then please refer to the estimate for that aspect, which is in addition to the fee estimate here, which relates to the Family Law Act application only.

There can be further disbursements, such as a process server to personally deliver documentation.
