CHILDREN ACT PROCEEDINGS FEES

If you are the Applicant or the person receiving the application, the costs are likely to be similar. The costs will depend very much upon the nature, length and complexity of the proceedings. In particular, how much correspondence is entered into to try and achieve an agreement.

Our typical ranges of fees for each stage of the process are laid out below.

The Children Act 1989 Application up to and including First Hearing

Time spent basis

£4,000 (plus £800 VAT) to £7,000 (plus £1,400 VAT) in addition to the court fee of £279).
Furthermore, we may need to instruct a barrister to represent you whose fees will be in the region of £2,500 (plus £500 VAT) to £3,500 (plus £700 VAT) per day

Continuing Proceedings

Preparing and Considering statements and attending Further Directions Hearing

Time spent basis

In addition to the above £5,000 (plus £1,000 VAT) to £10,000 (plus £2,000 VAT) in fees. Furthermore, a Barrister may also be instructed at fee cost from £2,500 (plus £500 VAT) to £3,500 (plus £700 VAT) per day

Contested Proceedings

Preparing for and dealing with the Final Hearing

Time spent basis

In addition to the above £8,000 (plus £1,600 VAT) to £20,000 (plus £4,000 VAT)
In addition, likely Barrister’s fees in region of £3,000 (plus £600 VAT) to £6,000 (plus £1,200 VAT) – plus a further £2,500 (plus £500 VAT) to £3,500 (plus £700 VAT) for each additional day.

 

The above assumes that the proceedings relate to one main Children Act issue (e.g. contact) and does not involve any Public Law (Care proceedings) aspect.

There can be further disbursements such as mediation fees or the cost of a hair strand test.
