Why Pre-Nups Are on the Rise (And Not Just for Celebrities!)

Discussing what might happen if a relationship ends, is rarely the most romantic part of planning your future together, but it can be much better for this frank conversation to be had at the beginning rather than having the worry and uncertainty of trying to resolve this in the midst of an emotionally fraught separation. In England and Wales, prenuptial agreements are not automatically enforceable, yet they can carry significant weight when properly prepared.

As the hotly anticipated wedding of superstar Taylor Swift and American Football star Travis Kelce approaches, they are reportedly preparing an "ironclad" prenuptial agreement. With Swift's estimated $1.6 billion fortune and Kelce being worth $90m, both parties reportedly want to keep their assets separate and remain financially independent.

But Pre-Nups are not just relevant for celebrity millionaires. More people are marrying later in life now, and as they bring assets into the relationship, or want to protect family wealth, so Pre-Nups are becoming an increasingly practical way for ordinary people to provide clarity and reassurance from the outset of their marriages.

Legally, Pre-Nups are not automatically enforceable in England and Wales, but they are becoming increasing prevalent, particularly for:
• Couples with pre-acquired or inherited wealth

A Pre-Nup can specify that different assets are treated in different ways, for example if one person brings a property into a marriage the Pre-Nup can specify that the property would be ringfenced and treated differently from assets acquired during the marriage.
• Couples where one or both are remarrying

A Pre-Nup can specify that certain assets are ringfenced and for example could give reassurance in relation to protecting inheritance for children from a previous marriage.
• Farming families

For example, if a farm is part of a family trust, then the Pre-Nup can specify that the family trust be treated differently to assets accumulated during the marriage.
• Young professionals who have built up some savings.

A Pre-Nup here can specify that savings acquired before a marriage should be treated differently from savings accumulated during the marriage. If there is no Pre-Nup then the starting point would be for all assets, whenever acquired, to be treated in the same way.

For a Pre-Nup to have the greatest chance of being given proper weight and consideration if there is an eventual separation, it is important that it is drawn up correctly, following the latest guidance and case law, with sufficient time between the Pre-Nup and the wedding, and with both parties having had full legal advice.
