Stay at home is a job in itself

The courts in the Family Jurisdiction appreciate that marriage is a partnership and much importance is given to the party who earns an income for the family by working outside the marriage as much as the party who stays at home and takes care of the household and  the children.

The end of an era

When a marriage comes to an end, the Court will do all it can to achieve a fair settlement, with an equal split of the marital assets being the starting point. It will look to share the assets built up during the course of the marriage and if necessary also at the assets earned before the marriage to meet the parties’ needs.

Court Discretion

The court has wide discretion and approaches each case differently; as a result, it is hard to take a broad view of what the outcome might be. It is important that one gets the best representation possible to meet the other side’s claim with strong arguments as the court will consider a number of factors when deciding how the assets should be split such as the length of the marriage, the way the wealth was created and grown, the needs and contributions of both parties.
