CHILDREN ACT PROCEEDINGS FEES

If you are the Applicant or the person receiving the application the costs are likely to be similar. The costs will depend very much upon the nature, length and complexity of the proceedings. In particular how much correspondence is entered into to try and achieve an agreement.

Our typical ranges of fees for each stage of the process are laid out below.

Negotiation and Initial Proceedings

The Children Act 1989 Application up to and including First Hearing

Time spent basis

£4,000 to £7,000 +VAT (plus court fee of £232)
Furthermore, we may need to instruct a barrister to represent you where fees will be in the region of £2,500 to £3,500 + VAT.

Continuing Proceedings

Preparing and Considering statements and attending Further Directions Hearing

Time spent basis

In addition to the above £5,000 to £10,000 +VAT
(a Barrister may also be instructed at fee cost of £2,500 to £3,500 +VAT)

Contested Proceedings

Preparing for and dealing with the Final Hearing

Time spent basis

In addition to the above £8,000 to £20,000 +VAT
(plus Barristers fees in region of £3,000 to £6,000 +VAT – plus £2,500 - £3,500 +VAT for each additional day)

 

The above assumes that the proceedings relate to one main Children Act issue (e.g. contact) and does not involve any Public Law (Care proceedings) aspect.

There can be further disbursements such as mediation fees or the cost of a hair strand test.
