Probate Disputes


If you find that someone is contesting a Will from which you benefit or you believe that you should have been provided for in a Will, we can help you. Also, if there is no Will and you believe you have been treated unfairly, we can tell you if you have a valid claim.
 
There are a number of situations where the provisions of a Will can come into question, for example – when there are doubts about the deceased’s mental capacity, when there have been drastic changes from the provisions of the previous Will or when someone may have exerted undue influence.
 
In any of these circumstances, we can help you to resolve the dispute, preferably without the need for court action. At such a distressing time, a negotiated but fair settlement is often the best option for all concerned, however, if a settlement cannot be agreed, we will guide you through the court process, helping you to prepare and representing you at any court hearings.
 
Claims can be made by:

  • the deceased’s husband/wife
  • an former husband/wife (who has not re-married)
  • a child of the deceased
  • someone the deceased regarded as his/her own child
  • the deceased’s "common law" spouse (not married but living together for at least two years)
  • anyone financially dependent on the deceased
